Terms and conditions
This is an English translation for your convenience. Only the German version is legally binding.
For renting the holiday home Seehaus Pippa. The key cancellation rules are in § 7.
§ 1 Scope and landlord
- These General Terms and Conditions apply to the rental of the holiday home “Seehaus Pippa”, Uferweg 11, 06249 Mücheln, Germany (rental property).
- The landlord is Ferienhaus DöDö GbR, represented by the partners Stephanie Döring and Markus Döring, Blumenstraße 5, 38118 Braunschweig, Germany.
- These terms apply to all bookings made directly with the landlord, in particular via the website, by email or by phone. For bookings via a booking platform, the platform’s terms take precedence for payment and cancellation; otherwise these terms apply.
- Conflicting terms of the tenant only apply if the landlord has expressly agreed to them in text form.
§ 2 Conclusion of contract
- By submitting a booking via the booking system or a binding booking request, the tenant makes an offer to conclude a rental agreement.
- The contract is concluded when the landlord confirms the booking in text form (e.g. by email). The details are set out in the booking confirmation and the rental agreement.
- The tenant must be of legal age when the contract is concluded. The tenant also acts on behalf of all fellow travellers and is responsible for ensuring that they comply with the terms of the contract and the house rules.
- There is no right of withdrawal, as this is an accommodation service for a specific period (§ 312g (2) no. 9 BGB). The cancellation rules in § 7 remain unaffected.
§ 3 Use and occupancy
- The rental property is let exclusively for holiday purposes.
- It may be occupied by a maximum of 6 persons including children; babies and toddlers under 3 years of age are not counted. Exceeding this number is only permitted with the landlord’s prior consent in text form.
- Subletting or making the property available to third parties is not permitted.
- Parties, stag or hen parties and similar events are not permitted. The tenant shows consideration for the neighbours; a security service keeps the marina quiet.
§ 4 Rental price and additional costs
- The rental price is stated in the booking confirmation. It applies to up to 4 persons; each additional person is charged €25 per night.
- In addition to the rental price, the following are charged:
- final cleaning: €150, or €195 for departures on a Sunday or public holiday
- electricity by consumption: €0.45 per kWh, read on arrival and departure
- optional: bed linen package €17.50 per person, towel package €17.50 per person, linen package (bed linen and towels) €30 per person
- All prices include statutory VAT.
- The prices agreed when the contract was concluded apply. Later price changes do not affect existing bookings.
§ 5 Payment
- Payment is made by bank transfer to the account stated in the booking confirmation or rental agreement.
- The amount and due dates of the deposit payment and balance are set out in the rental agreement.
- Electricity costs are settled after departure and offset against the security deposit.
- If the tenant defaults on a payment, the landlord may withdraw from the contract after an unsuccessful reminder with a reasonable deadline and claim compensation in accordance with § 7. Statutory claims for late payment remain unaffected.
§ 6 Security deposit
- The tenant pays a security deposit of €250 by bank transfer before arrival.
- The deposit is refunded within 14 days of departure, less the electricity costs and any damage caused by the tenant or fellow travellers and additional cleaning costs under § 9.
- Deductions are notified to the tenant in text form with reasons. If justified claims exceed the deposit, the landlord reserves the right to claim the remaining amount.
§ 7 Cancellation by the tenant
- The tenant may withdraw from the contract at any time before the start of the rental period. Cancellation must be declared in text form; the date of receipt by the landlord is decisive.
- In the event of cancellation, the landlord may claim the following flat-rate compensation, in each case based on the rental price:
| Cancellation | Compensation |
|---|---|
| up to 49 days before arrival | 10% |
| up to 35 days before arrival | 30% |
| up to 21 days before arrival | 60% |
| up to 14 days before arrival | 90% |
| less than 14 days before arrival or no-show | 100% |
- The tenant may prove that the landlord has suffered no loss or a significantly lower loss. If the period can be re-let, the landlord will credit the rent received.
- Further rules, in particular on providing a replacement guest, are set out in the rental agreement.
- We recommend taking out travel cancellation insurance.
§ 8 Withdrawal and termination by the landlord
- The landlord may terminate the contract without notice before or during the rental period if the tenant fails to make payments due despite a reminder, or behaves in such breach of contract that the landlord cannot reasonably be expected to continue it, in particular in the event of overcrowding, parties, unauthorised pets or considerable disturbance of the neighbours. In this case, the claim to the rental price remains; saved expenses will be credited.
- If the rental property becomes uninhabitable due to circumstances for which the landlord is not responsible (e.g. water damage, heating failure, official order), the landlord will inform the tenant immediately. In this case, all amounts already paid will be refunded in full. Further claims exist only under § 13.
§ 9 Arrival and departure
- The rental property is available from 3 pm on the day of arrival. On the day of departure, it must be vacated by 10 am.
- On departure, the rental property must be left in the following condition:
- waste separated according to the house rules and placed in the bins provided
- dishes washed and put away, fridge emptied
- oven, microwave and grill cleaned
- house swept clean, heavy dirt removed
- furniture, equipment and paddle boards back in their place so that wind cannot cause damage
- hot tub covered, windows and doors closed
- If these obligations are not fulfilled, the landlord may charge the proven additional cleaning or energy costs. The final cleaning under § 4 remains unaffected.
§ 10 Bed linen and towels
- Duvets and pillows are provided in the rental property.
- Bed linen, towels and tea towels are not included in the rental price. Please bring your own or book them as a package under § 4.
§ 11 House rules, pets and smoking
- The house rules form part of the contract and are binding for the tenant and all fellow travellers.
- Pets may not be brought into the rental property.
- The rental property is non-smoking. Smoking is only permitted on the terrace.
- In the event of a breach of paragraph 2 or 3, the landlord may charge the proven costs of any necessary special cleaning.
§ 12 Sauna, hot tub, jetty and lake
- The sauna, hot tub, jetty, swimming ladder and paddle boards are used at your own risk. The operating and safety instructions provided must be followed.
- The rental property is right on the water. Children may only be on the terrace and jetty under constant supervision by an adult. The lake is not a supervised bathing area.
- Wearing a life jacket is recommended when using the paddle boards; it is mandatory for children.
- The hot tub must be covered after each use. Glass is not permitted in the hot tub and sauna areas.
- The landlord’s liability under § 13 remains unaffected.
§ 13 Liability and defects
- The tenant is liable for damage to the rental property and its contents caused culpably by the tenant or fellow travellers.
- Defects and damage must be reported to the landlord immediately so that they can be remedied. If the tenant culpably fails to report them, the tenant’s claims may lapse to that extent.
- The landlord is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the case of slight negligence, the landlord is only liable for breach of essential contractual obligations and limited to the foreseeable, typical damage.
- Disturbances caused by public marina operations, boat traffic, construction work in the area or weather are beyond the landlord’s control.
§ 14 Internet and television
- The landlord provides Wi-Fi access free of charge. Constant availability or a particular speed is not guaranteed.
- The tenant may not use the access for unlawful purposes, in particular not for illegally downloading or distributing copyright-protected content. The tenant is liable for infringements via the access during the rental period and indemnifies the landlord against third-party claims.
- The access data may not be passed on to third parties. In the event of misuse, the landlord may block access.
- The settings of the television and satellite reception may not be changed permanently. If a technician has to be called out as a result, the tenant bears the proven costs.
§ 15 Charging electric vehicles
- Electric vehicles may only be charged at the wall charger provided and after prior arrangement with the landlord. Charging from household sockets is not permitted.
- A charging cable is not provided. The charging electricity is billed via the electricity charge under § 4.
§ 16 Final provisions
- Amendments and additions to the contract must be made in text form.
- Should individual provisions be invalid, the remainder of the contract remains valid. The invalid provision is replaced by the statutory provision.
- The law of the Federal Republic of Germany applies.
- If the tenant is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Braunschweig. Otherwise, the statutory places of jurisdiction apply.
- The landlord is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
